Terms of Service
## 1. Introduction These Terms of Service (the "Terms") govern your access to and use of the website www.devotiondresses.com (the "Website"), operated by Devotion s.r.o., a company registered in the Czech Republic with Company Registration No. 03835448, having its registered office at Nebušice, 164 00 Prague 6, Czech Republic ("we", "us", or "our"). These Terms constitute a legally binding agreement between you and us. By accessing the Website or placing an order for any product listed on the Website (a "Product"), you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. These Terms apply exclusively to consumers, defined as individuals acting for purposes outside their trade, business, craft, or profession. ## 2. Orders and Conclusion of Purchase Agreement ### 2.1. Placing an Order You may place an order by following the instructions on the Website. Your order constitutes an offer to purchase the specified Product(s). ### 2.2. Order Acknowledgment Upon placing an order, you will receive an email acknowledging receipt of your order details. This email is not an acceptance of your order but a confirmation that we have received it. ### 2.3. Order Acceptance and Confirmation A purchase agreement between you and us is concluded only when we have received your full payment of the Purchase Price (as defined below) and have sent you an email confirming our acceptance of the order (the "Confirmation Email"). We reserve the right to conduct verification of material availability before sending the Confirmation Email. ### 2.4. Right to Refuse Order We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. This includes, but is not limited to, limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or issues identified by our credit and fraud avoidance department. In the event your order is canceled after your payment has been processed, we will issue a full refund to your original method of payment. ## 3. Pricing and Payment Terms ### 3.1. Purchase Price The total price payable for a Product, including shipping costs, is the "Purchase Price". All prices displayed on the Website are inclusive of Czech VAT but are exclusive of any import duties, taxes, or customs fees applicable in your jurisdiction. You are solely responsible for the payment of any such charges. ### 3.2. Currency The final payment will be processed in EUR, GBP, or USD. Any currency conversions displayed on the Website are for informational purposes only. We are not responsible for any discrepancies resulting from currency fluctuations or bank commissions. ### 3.3. Payment Methods We accept payment via bank transfer, online card payment, and PayPal. Full payment of the Purchase Price is required for the conclusion of the purchase agreement. ### 3.4. Payment in Installments If you opt to pay in installments, a deposit is required at the time of order. The second installment is due when the Product arrives for its final quality control inspection in Prague, Czech Republic. You will be notified to make this payment. Failure to pay the second installment within fourteen (14) calendar days of notification will result in a storage fee of 50 USD per week, for a maximum of thirty (30) additional days. If payment is not completed within this extended period, the order and your deposit may be forfeited. ## 4. Delivery of Products ### 4.1. Shipping We will arrange for the delivery of the Product to the address specified in your order. The risk of loss or damage to the Product passes to you upon our delivery of the Product to the shipping carrier. ### 4.2. Liability for Delay We shall not be liable for any delays in delivery caused by the shipping carrier, customs clearance procedures, or other circumstances beyond our reasonable control. You are advised to order Products with sufficient lead time for your intended use. ### 4.3. Inspection upon Receipt You must inspect the delivery upon receipt for any damage or incompleteness. Any such issues must be reported immediately to both the shipping company and us. Failure to do so may limit your ability to claim for damages that occurred during transit. ## 5. Product Warranty and Defects ### 5.1. Product Specifications We warrant that tailor-made Products will be delivered in the size and measurements specified in your order, subject to a measurement allowance of up to 2.5 cm (1 inch). Ready-to-wear Products will conform to the characteristics described on the Website. ### 5.2. Limited Warranty Period We provide a warranty for Products against manufacturing defects for a period of fifteen (15) days from the date of your receipt of the Product. This limited warranty does not affect any statutory rights you may have under applicable consumer protection laws, which may provide for longer guarantee periods (such as the two-year minimum in the EU). ### 5.3. Exclusions This warranty does not cover: (a) normal wear and tear; (b) damage from improper use, storage, or maintenance; (c) mechanical damage; (d) alterations made by you or a third party; or (e) force majeure events. ### 5.4. Remedies If a valid defect claim is received within the warranty period, we will, at our discretion, offer either an exchange for a new, defect-free Product or a full refund upon our receipt of the returned defective Product. These are your sole and exclusive remedies for a defective Product, to the extent permitted by law. ### 5.5. Claim Process To obtain warranty service, you must submit a written claim to us and return the Product to our specified address in Prague, Czech Republic. We reserve the right to refuse claims for Products that are soiled or do not meet basic sanitary requirements. ## 6. Cancellation and Return Policy ### 6.1. Order Cancellation You may cancel your order by written notice to info@devotiondresses.com within twenty-four (24) hours of placing the order. After this period, the order is transferred to manufacturing, and cancellation is not possible. ### 6.2. Return of Custom-Made and Personalized Products In accordance with Article 16(c) of the EU Consumer Rights Directive, the standard right of withdrawal does not apply to goods made to the consumer's specifications or which are clearly personalized. As our dresses are individually handcrafted to your unique measurements and specifications, we do not accept returns or offer refunds for custom-made Products due to a change of mind or incorrect size selection. ### 6.3. Return of Standard-Sized (Non-Custom) Products For standard-sized Products that have not been customized, you may request a return within fourteen (14) calendar days of receipt. The Product must be returned to us within thirty (30) calendar days thereafter, in its original, unworn, and perfect condition with all tags attached. You are responsible for all return shipping costs. ### 6.4. Restocking & Disposal Fee For accepted returns of standard-sized Products, a deduction of 20% to 50% of the purchase price will be applied to your refund to account for the fact that all returned dresses are discarded and not resold. For items sold at a promotional discount, a flat deduction of 50% applies. Fees for services such as accelerated manufacturing are non-refundable. ### 6.5. Ineligible Items Custom accessories, undergarments, and dresses from the "Value Collection" are not eligible for return. ## 7. Virtual Try-On Feature ### 7.1. Description The Website offers a Virtual Try-On feature that uses artificial intelligence ("AI") to generate a visualisation of how a selected dress may look on you based on a photograph you upload. This feature is provided as a complimentary styling tool and is not a guarantee of the final appearance of any Product. ### 7.2. Consent and Voluntary Use Use of the Virtual Try-On feature is entirely voluntary. By uploading your photograph, you consent to its processing as described herein and in our Privacy Policy. You may choose not to use this feature without any impact on your ability to browse or purchase Products. ### 7.3. No AI Training Your uploaded photographs and the AI-generated images are **not used to train, fine-tune, or improve any AI or machine learning models**. Processing is limited solely to generating the requested try-on visualisation. ### 7.4. Data Handling and Retention - Your uploaded photograph is transmitted securely to a third-party AI service provider for processing. - For quality assurance purposes, temporary copies of your uploaded photo and the generated result are stored for a maximum of **five (5) days**, after which they are automatically and permanently deleted. - No biometric data, facial recognition templates, or persistent identifiers are created or stored. ### 7.5. Accuracy Disclaimer The Virtual Try-On feature produces an AI-generated approximation only. The generated image may not accurately represent the actual fit, colour, fabric texture, drape, or overall appearance of the Product. Differences between the generated visualisation and the actual Product do not constitute a defect or grounds for return, exchange, or refund. ### 7.6. Intellectual Property The AI-generated images are provided for your personal, non-commercial use only. All generated images include a watermark identifying DevotionDresses.com. You may share generated images for personal purposes (e.g., showing friends or family), but you may not use them for any commercial purpose without our prior written consent. ### 7.7. Limitation of Liability We make no warranties, express or implied, regarding the Virtual Try-On feature, including but not limited to its accuracy, availability, or fitness for a particular purpose. The feature is provided "as is". We shall not be liable for any decisions made based on the Virtual Try-On output. ## 8. Intellectual Property All content on the Website, including text, graphics, logos, and images (the "Content"), is our exclusive property or the property of our licensors and is protected by intellectual property. ## 9. Limitation of Liability To the fullest extent permitted by applicable law, our total liability for any claim arising out of or relating to these Terms or the purchase of any Product shall not exceed the Purchase Price you paid for the Product. We shall not be liable for any indirect, incidental, or consequential damages, including but not limited to any costs associated with the postponement or cancellation of a wedding or other event for which the Product was intended. ## 10. Governing Law and Dispute Resolution These Terms and any disputes arising therefrom shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law principles. Any disputes shall be resolved by the competent courts of the Czech Republic. ## 11. Amendments We reserve the right to amend these Terms at any time. Any changes will be effective immediately upon posting to the Website. Your continued use of the Website following the posting of changes constitutes your acceptance of such changes. The Terms in effect at the time of your purchase will govern that transaction.
